Texas Divorce With Children: Forms You Need and How They Work

A Texas divorce with children adds a SAPCR, parenting plan, and child support worksheet. Learn which forms you need and how conservatorship works.

Divorce With Children in Texas

When you and your spouse have minor children together, a Texas divorce requires additional forms to address conservatorship, possession, and child support. See the complete package on our Texas divorce hub.

The SAPCR

A Suit Affecting the Parent-Child Relationship (SAPCR) is the part of your divorce that deals with the children. It establishes conservatorship (decision-making authority) and possession (time with the child).

The Parenting Plan

Your parenting plan sets out conservatorship, the possession schedule, child support, and medical support. Texas presumes joint managing conservatorship is in the child's best interest; the Standard Possession Order applies unless parents agree otherwise.

Child Support Worksheet

Texas calculates child support as a percentage of the non-primary parent's net monthly resources — 20% for one child up to 40% for five or more, capped at a maximum resources amount. Medical support (health insurance) is also required.

Geographic Restrictions

Texas orders often include a geographic restriction limiting the child's primary residence to a specific county or region. Moving outside that area generally requires the other parent's agreement or a court modification.
